Considering Congress did not pass a law stating same sec couples can marry she is actually upholding the law. The Supreme court is not in the business of legislating.

Ever heard of a little thing called judicial review?

Edited by Stickman Al: 9/4/2015 5:45:45 PMNo new law was passed, a decision was made that ruled certain legislation unconstitutional.
 -

	No, they cannot do that.
 -

That's the point of the bloody Supreme Court
 -

	They just did.

Marriage is the law. The supreme court simply provided the equal protection under the law that already exists. So no, she's breaking the law.
 -

That is not within the supreme courts power.
 -

They and the constitution disagree with you. The supreme courts power is fairly broad. And how is a ruling on constitutional rights not within the supreme courts power? That is exactly what the federal court system is for.

Edited by Anti noise: 9/4/2015 6:49:49 PMThey gave a judicial opinion, they cannot change laws that are within the Constitution. They can only direct the congress to change said laws.
 -

Show me where in the constitution it talks about marriage?
 -

They can rule laws as unconstitutional, which is exactly what they did. They ruled that the laws the states were creating that banned same sex marriage were unconstitutional.
 -

They can rule them unconstitutional yes. However that ruling does not end the law.
 -

Yes it does That is the entire point of the branch
 -

Actually, it does, which is why it is.
